Hiring and recruiting

When hiring and recruiting, you need to be sure you conduct every aspect of the process legally. This includes avoiding discriminatory questions and processes during any part of the recruiting or hiring process. The US Equal Employment Opportunity Commission (EEOC) and the Pennsylvania Human Relations Commission (PHRC) make it clear that discrimination against a person based on any of the following while recruiting and hiring is illegal:

  • Race or color
  • Ethnicity or nationality
  • Sex (orientation and gender)
  • Marital status
  • Disability
  • Age
  • Religion (or lack of religion)
  • Pregnancy status

Pay and compensation

It is vital that all employees receive at least the Pennsylvania minimum wage. Aside from this minimum, non-exempt employees are entitled to overtime pay for any time worked over 40 hours in a week. Determining the proper classification of employees is pivotal to pay that is compliant with the Fair Labor Standards Act and state pay laws. Employers must closely monitor the number of hours that each employee works and be sure they have compensated appropriately. Additionally, the Equal Pay Act prohibits employers from paying an employee of one sex less than the pay an employee of the other sex receives for the same job with similar training and skill requirements.

Paid leave plans

The team at N. Stotler Law can help develop organizational paid leave plans. Under Pennsylvania law, employers are not required to provide employees with vacation benefits, either paid or unpaid. However, if an employment policy or contract provides for such payments, an employer must follow its policy consistently. PA law does not require employers to provide workers with paid sick leave, but an employer may choose to do so under their own policies.
